User agreement
The customer receives the scooter in its pure form. We do not require the scooter to have its original appearance when returning, however, in case of excessive contamination (presence of large lumps of dirt, large amounts of sand, traces of spilled liquids, etc.), you must pay the cost of additional cleaning of the scooter, which is estimated directly by the manager to whom you will return the scooter (from 20 to 150 euros), in in the case of a return with "normal contamination", you do not need to pay for anything.
If you need help on the road, you can contact the roadside assistance service at the number indicated by the pole and provide the pole number, the state number of the scooter, the owner of this vehicle, the scene of the accident and describe what happened. Please note that the assistance service is not directly related to the scooter rental company, so in case of a language barrier, you can contact the manager of our company, and then he will call the roadside assistance service to you. Please note that in case of a breakdown, you should always put up an emergency stop sign and wear a reflective vest.
If you need to return the scooter earlier than the time specified in the contract, you need to inform us in advance in any convenient way about the new return date. Attention!!! Funds for unused rental days are non-refundable.
If you need to extend the rental period, you need to inform us in any convenient way about the desired new return date, and if this scooter is available, you can extend the lease. Scooter renewal is only possible at the company's office.
In case of getting into a traffic accident, it is necessary to put up an emergency stop sign and wear a special reflective vest. If you are in an accident, there are no injuries and there are no disagreements between the participants, in this case you need to take a special form of the Euro protocol in the glove compartment of the scooter in the folder with documents, which all participants in the traffic accident must fill out, sign and keep a copy for themselves. If there is no agreement between the participants in what happened or there are victims, it is necessary to call the police and ambulance by emergency number 112.
Since we value customers who are loyal to our company and with whom we have no problems, we are ready to provide discounts from 1% to 7% of the rental price, depending on what you previously rented. You can find more accurate information about discounts for loyal customers in your personal account.
The driver must be at least 25 and no older than 68 years old, and have at least 3 years of driving experience.
For a period of more than 3 days – no mileage limit.
At 1 day - 300 km (total).
At 2 days - 500 km (total).
At 3 days - 600 km (total).
Any crossing of the border of the Spanish mainland is prohibited and is punishable by a fine of 200 euros.
THE FULL TEXT OF THE AGREEMENT
2. SUBJECT OF THE AGREEMENT
2.1. The Lessor provides the Lessee with a vehicle (hereinafter referred to as a scooter) in working condition for temporary use, and the Lessee undertakes to pay the rent for the vehicle and return the scooter to the Lessor in working condition on the day and time specified in the agreement as the end of the contract.
2.2. The rented scooter is equipped in accordance with the list given in Appendix No. 1 of this agreement and is an integral part of it.
2.3. The Tenant and the persons admitted to the management must be over 25 years old (inclusive). An exception is possible in agreement with the Landlord.
2.4. The rental price includes: unlimited mileage, road tax, IVA 21%, compulsory insurance of civil liability to third parties, tow truck in case of an accident, replacement of a scooter in case of breakdown (not through the fault of the Tenant), "second driver" service. not included: a full tank of fuel, the cost of delivering the scooter to the customer's location (negotiated individually), other paid options.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1 The Lessor provides the scooter in working condition and with a full tank of fuel, the Lessee returns the scooter with a full or empty fuel tank, depending on the selected fuel formula. The cost of unused (remaining) fuel in the tank is not refunded to the Tenant.
3.2. The Lessee does not have the right to change the structure of the scooter, remove or install accessories and parts without the permission of the Lessor.
3.3. Upon expiration of the agreement, the Lessee is obliged to return the scooter to the Lessor with all accessories, taking into account normal depreciation at a pre-agreed place and time.
3.4. In case of return of the scooter with a delay of more than 1 (one) hour, the cost of one day of rent will be charged in double amount for each day of delay.
3.5. The Lessee undertakes to:
3.5.1. Pay the fines received during the rental of the vehicle. If the fine is received after the end of the rental period of the scooter, then in addition to the cost of the fine, a fee of 40 (forty) euros is charged for its registration, in case of non-payment of the fine, information about the Tenant is sent to the police.
3.5.2. If the scooter requires deep cleaning after the return, the Lessor, at its discretion, may charge up to 100 (one hundred) euros from the Lessee.
3.5.3. In case of loss of the electronic key, the Tenant pays its cost 150 (one hundred fifty) euros and 50 (fifty) euros if the key is without electrical control, as well as the cost of its delivery to the customer if necessary.
3.5.4. Return the scooter to the Lessor's parking lot or in another place previously agreed by the parties.
3.5.5. The Lessee undertakes to pay the cost of parking (including after the end of the lease period if the scooter was not returned to the Lessor in due course), toll roads and other expenses related to the use of the scooter during the lease, except for maintenance costs and expenses incurred due to the fault of the Lessor.
3.6. In case of damage to the vehicle or an accident, the Lessee undertakes to:
3.6.1 Immediately report the incident to the police or other competent authorities and to the Lessor.
3.6.2. Collect the data of the accident witnesses and take the necessary photographs and marks.
3.6.3. If the fault of the Lessee exists, the Lessee is obliged to pay the cost of repairing the scooter and its downtime in the repair shop. The cost of repair is determined by the official dealer of the brand of a particular scooter.
3.7. The Lessor is obliged to:
3.7.1. Subject to the Tenant's compliance with all the terms of the contract, return the deposit within 5 (five) business days.
3.7.2. Issue or accept a scooter at the specified time and place.
3.7.3. In case of breakdown of the scooter through no fault of the Tenant, eliminate the cause of the breakdown or replace the scooter in the shortest possible time.
4. UNAUTHORIZED USE
4.1. When using a scooter, the Lessee is obliged to exercise proper care and caution in operation in accordance with its technical characteristics, observing the applicable traffic regulations and in any case avoiding any situation that could cause damage to this scooter or a third party. It is also the duty of the Lessee to prohibit the operation of this scooter to persons other than those authorized to do so in accordance with this agreement. In this case, the Lessee is directly responsible for any damage or losses caused to the rented scooter or to a third party in the appropriate case. Any case of non-compliance with what is set out in these paragraphs is interpreted as unauthorized use.
4.2. The Lessee is fully responsible for the damage caused to the inner and outer parts of the scooter as a result of its unauthorized use. In this case, he is obliged to pay all the resulting expenses.
4.3. In the event of a claim for payment in court, the Lessee undertakes to pay all costs arising from the relevant legal proceedings, the services of lawyers, court attorneys, court costs, etc., even if his participation in the trial is not mandatory from a procedural point of view.
4.4. Unauthorized use includes the following cases, given as an example, although not limited to them:
4.4.1. Towing of any other vehicle or trailer.
4.4.2. Riding in places unsuitable for public transport, for example, on beaches, racing car tracks, forest trails, country roads, etc
. 4.4.3. Riding on unpaved or paved roads, but with serious defects that could cause damage to the bottom of the scooter body.
4.4.4. Riding this scooter in restricted access areas, including, more specifically, airport lanes and other roads associated with use in the field of aviation and (or) for military purposes.
4.4.5. Careless attitude towards the appearance of light indicators or warning signals on the dashboard of a rented scooter. At the same time, by signing this agreement, the Tenant declares that he has familiarized himself with their meaning and possible problems.
4.4.6. Transportation of property, animals and, in particular, substances that are dangerous, flammable and (or) harmful to the vehicle, driver, passengers and others.
4.4.7. Transportation of people or property, which directly or indirectly implies a taxi service or the provision of transfer transportation.
4.4.8. Sublease of a scooter.
4.4.9. Using a scooter for any illegal activity.
4.4.10. Transportation of a larger number of passengers or the weight and dimensions of baggage that does not meet the technical characteristics of this vehicle provided by the manufacturer.
4.4.11. Performing any manipulations with the mileage meter or affecting it, while in case of failures in its operation, you should immediately inform the Lessor about this.
4.4.12. Leaving objects in the scooter in plain sight that may provoke their theft and this act would cause appropriate damage to the rented vehicle.
4.4.13. Pollute the scooter to a greater extent than it implies rational and careful use.
4.4.14. Using a scooter to teach driving, under any circumstances, and (or) to teach any skills while driving.
4.4.15. Driving a scooter is not in accordance with the rules of the road.
4.4.16. Driving a scooter by a person who does not have permission to do so according to the contract or in the absence of necessary documents.
4.4.17. Use of the scooter after the end of its rental period.
4.5. Smoking on a scooter is punishable by a fine of 200 (two hundred) euros.
4.6. A fine of 200 (two hundred) euros is imposed for traveling on a rented scooter outside the mainland of Spain, with the exception of Ibiza Island.
5. TERM OF THE AGREEMENT
5.1. This agreement comes into force from the moment it is signed by the parties.
5.2. If the scooter is returned by the Lessee earlier than the time specified in the contract, the cost for unused time is not refundable.
5.3. If the Lessee violates any condition of this agreement, the Lessor has the right to terminate the agreement unilaterally without prior notice and with appropriate confiscation of the vehicle, regardless of its geographical location. In this case, the Landlord is not responsible for the things and objects left by the Tenant in the scooter at the time of its withdrawal, but strives to take measures to protect the interests of the Tenant. The cost of the paid rent for unused days is not refundable in this case. The lessee is obliged to cover all the costs of the rental company related to the removal of the scooter.
6. OTHER CONDITIONS
6.1. Any changes to the agreement, or conditions not reflected in this agreement, must be reflected in the supplementary agreement to it in writing and signed by both parties.
6.2. The Agreement is drawn up in Spanish (the Russian, English and German versions are drawn up only to facilitate the understanding of the Lessee), signed in two copies, one for each of the parties, drawn up in accordance with the legislation of the Kingdom of Spain.
6.3. Disputes and disagreements under this agreement, the parties will try to resolve on their own. If it is impossible to overcome the differences independently, the parties will be guided by the legislation of the Kingdom of Spain and apply to the court in the territory of the Kingdom of Spain.
7. I agree that my personal data may be used/transferred to national and regional authorities, insurance companies, public or private bodies/organizations regarding processes related to traffic violations or identification of drivers who have not paid road tolls, as well as to the judicial and law enforcement authorities of Spain and The European Union. It is also due to the fact that my personal data can be processed in order to assess customer satisfaction. I understand that I can use my data access rights to correct, delete, or restrict access.
